SALEM, Ore. (AP) — A drunken driving citation for riding a bicycle while intoxicated still counts toward a “three strikes” rule on driver’s license revocation.
The Oregon Court of Appeals ruled Wednesday the state could revoke the license of a Deschutes County man who pleaded guilty to driving under the influence of intoxicants on a bike in 2008.
The court rejected arguments by Franklin Abbey that a bicycling-based conviction did not count for one of the three convictions needed for permanent revocation because a driver’s license is not required to operate a bicycle.
The court also rejected a variety of constitutional challenges that Abbey raised, including his argument the revocation denied him equal privileges as a driver.
