Retrial set for driver who hit teen on side of B.G. road

Deputy’s discovery of meth in her purse can’t be used as evidence again

An Amboy woman whose convictions were overturned in a 2013 car crash that seriously injured a Battle Ground teen was back in Clark County Superior Court on Tuesday to set a new trial date.

A state appeals court in July overturned Shaun C. Johnson’s convictions for vehicular assault and methamphetamine possession after finding that the Clark County sheriff’s deputy who discovered the drug had searched her purse illegally. That evidence was then erroneously allowed during Johnson’s trial.

The prosecution used the methamphetamine as evidence that Johnson, 49, was under the influence when she struck Justin Carey, then 16, as he waited for the school bus alongside Northeast 82nd Avenue in Battle Ground. Carey’s injuries later led to the amputation of his right leg.

Johnson admitted to law enforcement that she was an addict and had used the drug two days before the June 10, 2013, crash, court records state. Her blood later tested positive for methamphetamine, according to the prosecution.

She was sentenced in May 2015 to three years in prison.

During her Tuesday hearing, Judge David Gregerson, who presided over Johnson’s case, appointed defense attorney Shon Bogar to represent her again. Her bail was set at $50,000.

Johnson’s trial will begin Nov. 28.
