Charges dismissed in alleged rape case

Charges against two Vancouver men accused of raping a woman were dismissed Tuesday because of a lack of evidence, according to court records.

Wil-Anthony M. Noble, 19, and McKay T. Owsley, 21, each were charged with one count of second-degree rape in connection with the Jan. 22 incident. The charge was dismissed without prejudice, meaning it could be filed at a later date, court records show.

The men were suspected of assaulting the woman after all three had been drinking vodka and smoking marijuana at an apartment complex in the VanMall neighborhood, according to a probable cause affidavit filed in Clark County Superior Court.

The 18-year-old victim told police she became incapacitated but had sporadic memories the rest of the evening, including being sexually assaulted. A medical exam showed evidence that she had been assaulted, the affidavit said.
