A Vancouver man who was convicted in a stolen property case and on appeal was ordered to receive a new trial instead pleaded guilty Thursday to lesser charges.

Yevgeniy A. Smirnov, who’s about 37, pleaded guilty in Clark County Superior Court to attempted second-degree trafficking in stolen property and attempted second-degree theft with the intent to resell. Both are gross misdemeanors.

Smirnov had been found guilty of attempted first-degree trafficking in stolen property following a jury trial on Dec. 2, 2013.

The state appeals court reversed his conviction last summer because of a jury instruction error and ordered a new trial.

Smirnov and his wife allegedly sold thousands of dollars worth of items stolen from retail stores in Vancouver. Smirnov appeared to be a buyer of the stolen goods, according to court records.

He was given credit on Thursday for time served.
