Vancouver couple sue Fred Meyer over fall

Lawsuit claims woman slipped in water, broke knee

A Vancouver couple is suing Fred Meyer for injuries the wife sustained when she says she slipped and fell in a puddle of water inside the Fisher’s Landing store.

Melissa and Branden Crawford filed the lawsuit Monday in Clark County Superior Court. The lawsuit alleges that the store allowed the water to accumulate and did not provide nonskid protection or warning signs.

On the afternoon of June 30, 2012, Melissa Crawford was in the store at 16600 S.E. McGillivray Blvd. when she slipped on some water that had pooled on the floor near a drinking fountain. She fell and fractured her left knee cap, the lawsuit says.

Crawford reports that she has suffered emotional damage, including pain and suffering, loss of happiness and loss of enjoyment of life, the lawsuit says.

She is seeking an unspecified amount in damages, to be determined at trial, according to the lawsuit. She also seeks damages for medical expenses, as well as lost income.

Branden Crawford seeks damages for being deprived of his wife’s society and companionship, the lawsuit says.

Additionally, the lawsuit seeks relief for plaintiffs’ costs, disbursements and reasonable attorney’s fees.

The couple’s attorney, James L. Sellers, said the store was notified at the time of Melissa Crawford’s fall and immediately investigated the cause.

Efforts to reach a spokesperson for Fred Meyer were unsuccessful Thursday.
